PRIVACY POLICY, CARRIER TERMS & CONDITIONS

1. Said To Contain Basis & Inspection: All the consignment shall be booked on "said to contain basis" i.e. Goldmine Logistics India Private Limited shall be under no obligation to verify the description and contents of the shipment declared by the Consignor on the Consignment Note/LR/Invoice and as such the consignor shall undertake and ensure to make correct and factual declaration on the docket/Airway bill. However, Goldmine Logistics India Private Limited reserve the right to inspect and/or refuse booking of shipment not conforming to these terms and condition, only after duly informing consignor regarding the reasons for such inspection and/or refusal and after receiving the confirmation from consignor. Consignor shall not book, handover any shipment consisting of prohibited, restricted or dangerous products and Goldmine Logistics India Private Limited shall not be liable for any such shipment. Consignor indemnified and would keep indemnified Goldmine Logistics India Private Limited, its directors and employees against all claims, losses, charges and expenses incurred by Goldmine Logistics India Private Limited due to any banned, restricted or dangerous items entering in to the network of the Goldmine Logistics India Private Limited due to any commission or omission of Consignor.
2. The consignments booked and carried by Goldmine Logistics India Private Limited stand cleared by the Custom/ Excise/ GST authorities and any confiscation on account of lapses or non-compliance of the statutory requirements would be the responsibility/ liability of the Consignor/Consignee.
3. Goldmine Logistics India Private Limited will ensure smooth, damage/ non-delivery of all packages/ delivery of short packages, Goldmine Logistics India Private Limited will ensure settlement as per liability for loss and damage agreed in the below sub-clause.
a). The transit insurance of the consignments to be done by Consignor / Consignee. Liability of Goldmine Logistics India Private Limited shall be to settle claims up to Rs.5000/- per waybill through credit notes, subject to remarks on POD and after produce of consignment related documents like invoice, E-Way bill by the Company.
b). Claims above Rs.5000/- per waybill shall be settled through Certificate of facts (COF), subject to remarks on POD. It is agreed that COF shall be issued by Goldmine Logistics India Private Limited, upon receipt of claim letter from the Company within 7 (seven) days of delivery of consignment along with invoice, E-Way. It is further agreed that if the aforesaid claim letter is not submitted by the Consignor/Consignee within the timelines, in such cases Goldmine Logistics India Private Limited shall not be liable to the Consignor / Consignee for any rejection of claims by insurance Company.
c). The copy of the Police complaint shall be provided only in the cases of accident, fire, hijack of vehicle, theft & burglary (forceful entry in warehouse or vehicle).
4. Transit Schedule:
While every effort will be made to strictly adhere to the transit time/ schedule, Goldmine Logistics India Private Limited will not be responsible/ liable for any delays resulting from situation such as riots, civil commotion, strikes, bandhs, disturbed conditions, accidents, detention of vehicles/ containers at Check-posts, etc., or for any other reason beyond our control. Goldmine Logistics India Private Limited will not accept any responsibility/liability for any consequential losses, if any, suffered by a customer due to delayed delivery of the consignment.
5. Mode of Transport
Goldmine Logistics India Private Limited is entitled to use any mode and route for transportation.
6. Contract
The Consignment Note /Way Bill / Docket / LR is a contract between Goldmine Logistics India Private Limited and customer.
7. Non-Negotiable
The Goldmine Logistics India Private Limited Consignment Note /Way Bill / Docket / LR is non-negotiable and the consignor acknowledges that it has been prepared by the Consignor or by Goldmine Logistics India Private Limited on behalf of the Consignor.
8. Acceptance of Terms and Conditions
By giving us your shipment you accept our terms and conditions set out in the Consignment Note /Way Bill / Docket / LR or the contract of carriage and/or the contract for the performance of other services on behalf of yourself and/or anyone else who has an interest in the shipment or the performance of other services irrespective of whether you have signed the front of our consignment note or not. Our terms and conditions also cover and can be invoked by anyone we use or sub-contract to collect, transport, deliver your shipment or perform other services as well as our employees, directors and agents. Only one of our authorized officers may agree to a variation of these terms and conditions in writing. When you give us the shipment with oral or written instructions that conflict with our terms and conditions we shall not be bound by such instructions.
9. Insurance
The transit insurance of the consignments to be done by Consignor / Consignee.
10. Documentations
Proper and completed documentation by the customer is compulsory required along with accurate details of the shipper/receiver's name, address, telephone Nos, email-id and forms, waybills, invoices etc. as per the statutory requirements. Goldmine Logistics India Private Limited shall not be made responsible /liable in case of any deficiency in the documents/statutory requirements and no claim or grievance of any nature shall be entertained. Customer hereby undertake to make good the loss to Goldmine Logistics India Private Limited in case their shipment(s) cause damages to other shipment(s) loaded in the vehicle due to inherent nature and which is wrongly declared by the customer OR in case of seizure by any government authority due to improper and incomplete documentation as a result other shipment (s) also get delayed resulting in a loss to Goldmine Logistics India Private Limited. Goldmine Logistics India Private Limited shall not be liable for any kind of damages to the goods caused due to improper and defective packaging of goods.
11. Statutory payments
The customers are solely responsible for all payments, Taxes, Penalties if any, levied by the government or any statutory body etc. Further customer has agreed to make good the loss to Goldmine Logistics India Private Limited, in case of any claims being lodged on Goldmine Logistics India Private Limited by Statutory authorities due to insufficient documents or wrongful declaration by the customer.
12. Right to entrust
The Company reserves the right to entrust the goods to any other carrier. Transit time may get impacted by strikes, political rallies, road closures, lock & extreme weather calamities including for, snow, storms, Floods, route diversions due to religious festivities, etc.
13. Lien
Goldmine Logistics India Private Limited shall have a general lien over all the consignments of the customer towards any dues payable to Goldmine Logistics India Private Limited by the customer.
14. Claims
No claim shall be entertained by the Goldmine Logistics India Private Limited for any loss or shortage/damage/non-delivery/breakage/leakages/pilferage etc. of the consignment unless a written claim is lodged within 30 days from the date of booking, subject to remarks on the proof of delivery. Goldmine Logistics India Private Limited shall not entertain any claims arising due to delay in delivery of consignment for any reason.
15. Chargeable Weight
Actual or Volumetric weight whichever is higher will be considered while calculating the rates. Chargeable Weight: Voluminous Cargo Calculation as per formulae adopted by Railways. Chargeable weight will be rounded up to next 1 Kg.
16. Exclusions
We will not be liable for any loss of income, loss of profits, loss of markets, loss of reputation, loss of customers, loss of use, loss of an opportunity even if we had knowledge that such damages or loss might arise or for any indirect, incidental, special or consequential damages or loss howsoever arising including without limitation breach of contract, negligence, willful act or default. We are not liable if we do not fulfill any obligations towards you at all as a result of Circumstances beyond our control such as Acts of God including earthquakes, cyclones, storms, flooding, fire, disease, fog, snow or frost or other natural calamities or disasters Force majeure including war, accidents, acts of public enemies, strikes, embargoes, peril, local disputes or civil commotions etc.
17. Return to Origin (RTO)
If the customer/Consignee does not take delivery of the shipment for any reason whatsoever. Goldmine Logistics India Private Limited shall intimate to the customer/consignor and upon request of the consignor Goldmine Logistics India Private Limited return the shipment and raise the bills on the consignor towards the transportation and other charges including transport charges in accordance with the terms of the contract and the customer shall be liable to pay all dues payable to Goldmine Logistics India Private Limited whether at the original booking station or elsewhere as notified by Goldmine Logistics India Private Limited .
18. End User Account and Data Privacy
The Website allows Goldmine Logistics India Private Limited and its concerned persons to have access to User's personal email and phone number, for the communication and analytics.
19. Terms in addition to special contracts
The terms and conditions stipulated are in addition to special contracts, if any between Goldmine Logistics India Private Limited and the customer.
20. The Company will Charge warehousing and demurrage charges on consignment kept at Company’s warehouse or premises beyond 7 days of arrival. The Charges will be Rs. 10/- per package per day or it may vary depend upon parcel size.
21. The Company shall have the right to dispose the perishable articles lying unclaimed after 48 hours of arrival and other goods after 30 days of arrival without any notice.
22. No suit shall be against the company in respect of in relation to the subject consignment after the expiry of 3 months from the date of booking.
23. No claim for loss or damages will be entertained until all charges for freight. Storage / warehousing charges, Octroi state and local taxes and advances, COF charges / Valuation charges etc. have been paid. The amount of any such claim shall not be deducted from any of the aforesaid charges due to Goldmine Logistics India Private Limited.
24. No deduction from invoices will be allowed on account of any reason, including non-submission of PODs, claim settlement etc.
25. PAYMENTS:
The Customer shall pay the freight and other charges within due date from the date of submission of invoice, in case of non-payment of invoice amount within stipulated time Customer shall be liable for payment of interest @24% per annum.
26. Transit Time:
Pickup and Delivery time as per agreement, Pick-up day is not included in the calculation of transit time. The performance level is targeted at 90% +, with a consideration of 1 day grace period. For late pick-up, i.e. after the cut-off time of 18:00 Hrs. next calendar date will be considered as the booking date.
27. Right to Change
The Company reserves the right to change the clauses mentioned in the terms and conditions without any prior notice.
28. Governing Laws and Jurisdiction:
The Contract shall be governed by the Laws of India and courts at Mumbai, will have the jurisdiction in case of any disputes related to the contract.

> Oil-based paint and thinners (flammable liquids).
> Industrial solvents.
> Insecticides, garden chemicals (fertilizers, poisons).
> Lithium batteries.
> Magnetized materials.
> Machinery (Chain saws, outboard engines containing fuel or that have contained fuel).
> Fuel for camp stoves, lanterns, torches, or heating elements.
> Automobile batteries.
> Infectious substances.
> All the goods which are prohibited by airport authority of India.
> Liquid Shipments.
> Any compound, liquid or gas that has toxic characteristics.
> Bleach.
> Flammable adhesives.
> Arms and ammunition and Crackers.
> Dry ice (Carbon Dioxide, Solid).
